Sexual Assault Reporting

  • Nursing and medical providers are mandated to report suspected child abuse to CPS and/or law enforcement when the victim is under 18 years of age.
    • The age of consent for sex varies from state to state.
  • Contact CPS in the county in which child resides.
  • Some adolescents may refuse to seek care or disclose personal information because reporting of sexual partners or incidents of sexual violence may be required.
  • Mandatory reporting to child protective services should be completed and patient should be made aware that such reporting will take place.
  • Mandatory reporting applies even when minor has signed consent for their own care.
  • Advise patient/parent/caregiver of mandated reporting to CPS and/or law enforcement unless doing so would jeopardize the safety of other children.
  • All mandated reporting must be documented within the medical record.
